Jammu, DD, The significant case regarding nomination of five MLAs scheduled to be taken-up today, could not be listed in view of the non-availability of the bench due to proposed judicial conference in Srinagar on July 27th.
The PIL filed by Former MLC and Chief Spokesperson JK Congress Ravinder Sharma Advocate challenging the provisions and powers of nomination of five MLAs by the Lt Governor to the Legislative Assembly of J&K UT was scheduled to be taken up today.
However the bench couldn’t be constituted due to movement of judges to participate in a judicial conference at Srinagar scheduled for Sunday
On the last date in the case on April 30th, the Court had granted last & final opportunity of four weeks to the GOI to file reply in matter and had fixed july 25th, the date for final hearing.
The Special Division Bench of Justice Sanjeev Kumar and Justice Rajesh Sekhri is hearing the important matter since October last year.
The respondents including GOI has failed to file the reply to the averments in the petition and the court was apprised by the Counsels for Petitioner about this fact and the delay being caused on this count.
Upon this the Division Bench had granted last and final opportunity of 4 weeks to the respondent to file reply to the petition and four weeks, thereafter to the Petitioner to file rejoinder to the same and fixed the matter to be listed for hearing today.
However no reply has been filed by the UOI and the other respondents, so far as per Petitioner.
The case is hotly contested as Senior Supreme Court lawyer Dr Abhishek Manu Singhvi alongwith D K Khajuria, SM Chaudhary is appearing for the Petitioner while Addl Solicitor General Tushar Mehta is appearing for GOI alongwith ASGI Vishal Sharma for the respondents.
The next date in the case shall now fixed next week after seeking instructions from the bench. (Press Release)
