Jammu: TDD,The All India OBC Union Social today condemned the misleading propaganda launched by the vested interests claiming that reservations for general categories in Jammu and Kashmir have gone down to 35% which is totally wrong.
According to the Supreme Court of India in a judgement of 1992 on mandal report, there is a 50% cap after providing reservations to SCs @15%, STs@7.5%and OBCs@27%.This all totalling to 49.5%.
In Jammu and Kashmir, the reservations given to SCs is 8%, for STs is 10% and to OBCs is 8% instead of 27% there by totalling to 26%. The rest of the 74% quota goes to general categories in one way or the other.
The reservations on the name of areas are totally unconstitutional and illegal but still in place in spite of abrogation of art 370.
The reservations meant for SCs, STs and OBCs were vertical ones but in Jammu and Kashmir all reservations other than SC, ST, OBC are too vertical which are unconstitutional and illegal.
Such reservations should either be eliminated or if there is will of the govt to continue, then these reservations must be adjusted horizontally.
