Ramban:DD, The Bar Association Ramban today extended support to the call for restoration of judicial powers.
Addressing a press conference here, Secretary of the Ramban Bar, Adv Asif Hamid Itoo, along with Adv Fairoz Khan, Adv Samrat Prahrir, and members of the Ramban Bar, expressed serious concern over the shifting of judicial and quasi-judicial powers to revenue authorities and the recent implementation of the J&K Tenancy Act.
Speaking on behalf of the Association, the Secretary stated that the Bar stands firmly with the observations made by the Presidents of the J&K High Court Bar Association, Jammu, and the Kashmir Bar Association, Srinagar.
The Association stressed that diverting traditionally judicial functions to revenue officials has created imbalance, procedural confusion, and needless hardship for advocates and litigants.
Advocates in Ramban noted that revenue officers, despite their administrative role, are not institutionally trained to handle matters requiring judicial application of mind.
“This shift has already resulted in delays, misinterpretation of legal provisions, and a rise in procedural bottlenecks that could have been avoided had proper consultation been undertaken with the legal fraternity,” the Ramban Members said.
The Association urged the Lieutenant Governor, Manoj Sinha, to immediately withdraw or review the circulars and notifications that place judicial responsibilities in the hands of the executive.
They also reiterated the need to revisit the Tenancy Act in its present form, as several of its provisions impose avoidable burdens on citizens and complicate the functioning of the courts.
The Ramban Bar emphasised that the legal fraternity carries the duty to preserve the integrity of judicial processes. Any erosion of judicial authority weakens the justice delivery system and affects the rights of the public at large.
The Bar Association Ramban reaffirmed its commitment to stand united with all Bar bodies across Jammu and Kashmir in upholding judicial independence, institutional balance, and the rule of law.DD
