Jammu: DD, The High Court of Jammu & Kashmir and Ladakh has stayed further investigation in FIR No. 0234/2025 registered at Police Station Kishtwar, granting interim protection to the petitioner Ghulam Nabi who had approached the Court seeking quashment of the FIR.
Justice Mohd. Yousuf Wani, while issuing notice to the respondents, directed that the investigation in the impugned FIR dated 12.11.2025 shall remain stayed till the next date of hearing.
The petitioner was represented by Advocate M. A. Dar along with Advocate Irfan Khan, who argued that the case was essentially a civil dispute concerning boundary plantation and overhanging trees, but had been wrongly given a criminal colour. Counsel submitted that the FIR had been registered in violation of mandatory procedure, as most of the invoked offences were non-cognizable under BNS, 2023, and no preliminary inquiry or Magistrate’s permission had been obtained before registration.
After hearing the petitioner’s counsel and examining the interim application along with the annexed documents, the Court issued notice to the respondents, seeking objections within one week of service.
Listing the matter on 29 December 2025, the Court ordered:
“… till the next date of hearing before the Bench, the further investigation in the impugned case FIR bearing No.0234/2025 dated 12.11.2025 registered with Police Station, Kishtwar, shall remain stayed.”DD
