Wife Booked for Torture, Threats to Husband, Daughters and Elderly In-Laws in Jammu

Jammu, (DD): In a disturbing case of alleged domestic violence and threats to life, Police Station Janipur in Jammu has registered FIR No. 0094/2025, dated 01.07.2025, against Beera Bibi, wife of Zakir Hussain, under various sections of the Bharatiya Nyaya Sanhita (BNS), 2023, following directions issued by the Special Excise Mobile Magistrate, Jammu, Brij Raj Si3ngh.

The FIR has been filed under Sections 115(2) (voluntarily causing hurt), 126(2) (wrongful restraint), 131 (assault or criminal force), 132 (assault or criminal force to deter public servant from discharging duty), and 351(3) (criminal intimidation with threat to cause death or grievous hurt) of BNS, 2023.

According to the complainant Zakir Hussain, a former army man currently employed with the postal department, his wife has consistently subjected him, his two minor daughters, and elderly parents to inhuman treatment and physical assault. He claimed that despite multiple attempts to lodge a formal complaint with the local police and the SSP Jammu, action was only taken after the intervention of the court.

Allegations of Abuse and Attempt to Murder

The complaint highlights a series of violent incidents, notably on 12th March 2025, when Beera Bibi allegedly abused their 7-year-old daughter and attacked Zakir with bricks. Zakir claims to have recorded a 6:41-minute video showing his wife assaulting him and their elder daughter, which was submitted to the court as evidence.

A subsequent incident on 13th March 2025 involved Beera allegedly hurling a metal plier at Zakir and his younger daughter while she was preparing for her final UKG exam, reportedly preventing her from attending the exam. The FIR states that Beera physically assaulted Zakir again and obstructed his movement even in the presence of police officials.

Zakir further alleges that his wife has a history of disruptive behavior, often creating public scenes at his workplace—Post Office Sidhra—to harass and intimidate him, affecting his ability to perform official duties.

Police Reluctance and Court Intervention

The complainant claimed that despite reaching out to the police multiple times, no FIR was registered due to Beera Bibi’s alleged connections with retired SSP Mir Mohammad, who is not related to either party but is said to influence proceedings through unwarranted calls from the PCR. Zakir also accused local officers of sympathising with his wife due to her emotional manipulation at the police station.

With no action taken by the police, Zakir filed an application under Section 175(3) BNSS, 2023 before the Special Excise Mobile Magistrate, seeking court directions to compel the SHO Janipur to file an FIR.

After reviewing the video evidence and case documents, Magistrate Brij Raj Singh observed that “there are sufficient grounds to proceed against the accused”, and ordered the SHO to register a formal FIR and begin investigation.

Legal Counsel and Evidence

Zakir was represented by Advocate Supriya Chouhan along with Advocates Adnan Mushtaq Jaral, Vishal Gupta, Mohd. Usman, and Nadeem Choudhary, who placed on record the repeated threats and assaults, supported by multiple mobile phone videos recorded by the complainant and his elderly mother Suraiya Bibi.

Following the court’s direction, FIR No. 0094/2025 was formally lodged on 1st July 2025, setting the stage for a detailed police investigation into the matter(DD)
